Presumption of law taken in sub-section (3) of Section 4 of PC & PNDT Act
“Person conducting ultrasonography on pregnant women shall keep complete record thereof in the clinic in such manner, as may be prescribed, and any deficiency or inaccuracy found therein shall amount to contravention of the provisions of section 5 or section 6 unless contrary is proved by the person conducting such ultrasonography.
This presumption has made every PNDT Centre, its owner & operator vulnerable to violation equivalent to sex determination and highest penalties including imprisonment irrespective of grade of violation.
Penalty for contravention of any provisions of PNDT Act & Rules
have been made very stringent and Owner, Director, Operator, Ultrasonologist, radiologist shall be punishable with imprisonment for a term which may extend to five years. In some cases with additional sections of I.P.C. or Cr. P.C it may extend up to life imprisonment.
At the stage of framing of charges itself, suspension of the registration by State Medical Council
Under section 23(2) of PC & PNDT Act, the name of doctor concerned shall be reported to State Medical Council, at the stage of framing of charges itself, for suspension of the registration, till the case is disposed and on conviction, for removal of the name for a period of five years, for the first offence and permanently for the subsequent offence.
